LA SUPERIORITÀ DEL TAR LAZIO SI CONFERMA SULLA DECADENZA DELLA PA DIREZIONE GENERALE CINEMA

Ho letto, oltre, tra le righe di questa seconda sentenza a mio favore, ricevuta ieri 12 agosto 2021.

Ho apprezzato ancor di più la sensibilità del TAR LAZIO, l’eleganza, l’animo nobile e quanto è geniale!

Ha sentenziato dipanando con ancor più logica e ragione.

“Il Collegio ritiene che la circostanza rappresentata dalla ricorrente non sia N. 06697/2021 REG.RIC. sufficiente a dimostrare l’ipotizzato sviamento di potere, pur non negando che, nello sviluppo concreto della vicenda, vi siano elementi potenzialmente suggestivi in tal senso.”

La PA è in  Knock Down, ossia in ginocchio. Ancora un’altra sentenza così e va gambe all’aria…senza possibilità di rialzarsi.

L’accanimento della Pubblica Amministrazione Direzione Generale Cinema contro me, Gianna Garbelli, non ha eguali.

Lo scorso 10 Marzo 2021, cerca in questo mio Blog il titolo:

dove vi riportavo con il cuore accelerato di felicità le NUMERO TRE SENTENZE del TAR a mio favore, a proposito dei miei documentari sottoposti alla Commissione Cinema del Ministero della Cultura per il finanziamento.

Tutti e tre sono stati da me realizzati. Tutta l’esposizione economica a mio carico, ne sono l’autrice/produttrice. Più altri due, insomma un totale di 5 ricchissimi documentari di Cultura Sportiva.

Evidentemente non sono bastate le TRE SENTENZE alla PA Direzione Generale Cinema, alla  Commissione “di esperti” per intendere di cosa si tratta e così mi hanno cassata di nuovo…

E di nuovo lo scorso 6 giugno io ho fatto ricorso.

LA SUPERIORITÀ DEL TAR LAZIO SI CONFERMA SULLA DECADENZA DELLA PA DIREZIONE GENERALE CINEMA

Nel torrido pomeriggio di ieri 12 agosto 2021, ho ricevuto dal mio stimato legale amministrativo, Francesco Vannicelli, stesso studio del precedente avv Alessandro Malossini, la sentenza pubblica dello scorso 5 agosto per il mio docufilm su mio Padre:

• Il Fighter d’Italia Giancarlo Garbelli – il pugilato è violento ma la violenza non è pugilato

Nel frattempo la Pubblica Amministrazione Direzione Generale Cinema ha fatto appello al Consiglio di Stato per gli altri due documentari anch’essi sentenziati a mio favore, l’udienza è per marzo 2022. Questi i titoli

• Garbelli On Boxing/ A Mani Basse – Emozioni di Viaggio nella Boxe Senza Tempo
• Garbelli On Boxing/ A Mani Basse – Se Non Esiste l’Amore Non Esiste Neanche Il Pugilato

La Pubblica Amministrazione si è così coperta di ridicolo, e qui la sentenza ben chiarisce inequivocabilmente.

Vi prego di leggerla, è documento pubblico che evidenzia quanto sia fondamentale la Giustizia per far valere  i propri diritti anche quando, come nel caso del cinema, questi siano offuscati da una pretesa di valutazione di argomento che invece ignora completamente. E le giustificazioni sono arrampicate sui vetri…

Capisco che in Italia, lo Sport si legge Calcio. Ma non è il mio caso. Appunto ho inteso colmare il vuoto culturale.

E certo provoco un certo rigurgito a chi non è abituato al confronto.

Tendo la mano come si conviene nella Nobile Arte, che sintetizza sport e arte, espressione delle più incredibili capacità dell’animo umano.

Lo propone l’Illustrissimo TAR LAZIO, leggere bene le righe, e anche tra le righe…

Pubblica Amministrazione Direzione Generale Cinema, sei certa di voler bocciarmi ad oltranza senza logica e ragione…?

Chissà se qualche quotidiano nazionale avrà il “coraggio” di darmi man forte e mettere in evidenza la mia ribellione ad un sistema che è risaputo decadente…del resto tutte le redazioni mi guardano quando si tratta di cultura della boxe…

I have also read between the lines of this second sentence in my favor, received yesterday, August 12th,  2021.

I appreciated, even more, the sensitivity of TAR LAZIO, the elegance, the noble soul, and how brilliant it is!

It ruled unraveling with even more rhyme and reason.

“The Board believes that the circumstance represented by the appellant is not N. 06697/2021 REG.RIC. sufficient to demonstrate the alleged misuse of power, while not denying that, in the concrete development of the matter, there are potentially suggestive elements in this sense. “

The PA is in Knock Down, i.e. kneeling. Yet another sentence like that and goes upside down … with no chance to get up.

The fury of the Public Administration Directorate General Cinema against me, Gianna Garbelli, has no equal.

where I reported with the fast beating heart of happiness the NUMBER THREE SENTENCES of the TAR LAZIO in my favor, about my documentaries submitted to the Cinema Commission of the Ministry of Culture for funding.

All three were made by me. All the financial exposure is at my expense, I am the author/producer. Plus two more, in short, a total of 5 very rich Sports Culture documentaries.

Evidently the THREE JUDGMENTS of the Regional Administration Court to the PA Directorate General for Cinema, the Commission “of experts” were not enough to understand what it’s about and so they quashed me again …

And again last June 6 I appealed.

CONFIRMED THE SUPERIORITY OF TAR LAZIO COURT ON THE DECADENCE OF THE Italian Public Administration DIRECTION GENERAL of CINEMA

In the scorching afternoon of yesterday August 12th, 2021, I received from my esteemed administrative lawyer, Francesco Vannicelli, the same firm as the previous lawyer Alessandro Malossini, the public sentence of last August 5th,  for my documentary film on my Father:

• Il Fighter d’Italia Giancarlo Garbelli – boxing is violent but violence isn’t boxing-

In the meantime, the Italian Public Administration Directorate General for Cinema has appealed to the Council of State for the other two documentaries also sentenced in my favor, the hearing is for March 2022. These are the titles

• Garbelli On Boxing / Hands Down – Timeless Boxing Tale Come to Life
• Garbelli On Boxing / Hands Down – If Love Doesn’t Exist, Boxing Doesn’t Exist

The Public Administration has thus covered itself with ridicule, and here the judgment clearly clarifies.

Please read it, it’s a public document that highlights how fundamental Justice is to assert one’s rights even when, as in the case of cinema, these are obscured by a claim to the evaluation of the subject which instead completely ignores. And the justifications are climbing on the glass …

I challenge any of these “experts” of the Public Administration Cinema Direction that I have never seen at any ringside on the whole planet, to know a nail of my topic: the sporting culture of which I am paladin, the boxing culture.

THREE JUDGMENTS that the Italian Cinema General Administration insists on deceiving … without reason.
Because not only it’s incompetent about the content, but the stubbornness with which it closes in on itself, is proper to dullness, that torpidity, that lack of curiosity, that wall raised in defense of a profound cultural void precisely of sports culture, almost this both as opposed to the whole general culture …

I understand that in Italy, the Sport is Football. But that’s not my case. In fact, I intended to fill the cultural void

I have already written, in cinema, there is no meritocracy.

The emotions that transpire from sports are real and I have had the privilege of touching them not just because I was born there, and thus of making my documentaries for visibility all over the world.

I was able to do it because I know very well the world of Boxing, Theater, Cinema, and of course Literature, and bringing back emotions is what I have done in the last 25 years …
I didn’t miss any fundamental stage in my artistic growth. In my research.

My work is multilingual with over 400 champions … in 50 boxing capitals!
And it’s not by sending me to hell that I disappear …

In addition, on this blog of mine, I have tens of hundreds of thousands of readers all over the world and certainly also among the Italian Public Administration Cinema Direction which, with its rejection, confirms that it doesn’t appreciate my transparency. I have the courage of my convictions.

And I certainly cause an undoubted  regurgitation in those who aren’t used to being able to contend with another as an equal in quality

The PA not only doesn’t know about sports culture, no basic boxing elements, in which case it would know how to respect me,  but finds non-existent quibbles in order to have the economic control of the disbursement of public money, to submit to his will, to have the dominion of culture … which it monopolizes without restraint, so it directs his thought.

This Sports Culture that I instead make public and popular, and I intend to spread its immense values. The same ones I grew up in.

Last spring 2021, I was again “rejected” by this decadent Italian Public Administration General Direction Cinema, the smoking circle… is always the same, the identical people who go out the door to enter through the window …

In such an exceptional summer, full of true and strong emotions as Sport can give, this ignorant rudeness screeches.

Almost two decades have gone by like this, and no one gives me back … inestimable damage!
I’m not giving up, get over it!

I hold out my hand as befits the Noble Art, which synthesizes sport and art, expression of the most incredible abilities of the human soul.

I propose to conclude as the Boxing Champions do, after the confrontation in the ring, respecting the opponent, if not in the embrace, at least with a handshake, to put an end to this useless dispute that sees me undergo every possible and useless and unfair verdict, and thus acknowledge the cultural supremacy of my matter and the consequent economic recognition.

The Illustrious TAR LAZIO COURT proposes it, read the lines well, and even between the lines …

It takes humility to recognize one’s limits, without imposing oneself on initiative, creativity, and truth because the protagonists of my docufilms are all, not only this in the Judgment of the Lazio TAR Court, on my Father “Il Fighter d’ Italia Giancarlo Garbelli”, in all my works,  they are the stars who have contributed to human and civil growth from wherever they come, they are the protagonists: the real Champions!

ITALIAN Public Administration Directorate General Cinema, are you sure you want to reject me to the bitter end without rhyme and reason …?

They aren’t really puppets … and what about if I tell you as I am also an actress/director, there is no comparison between the truth and the reconstruction of the character.

The real protagonist is more and more exciting. And it takes a straight back to tell certain truths.
The fiction is interesting if there is a reconstruction and plot that emphasizes different eras. Even in fiction, you can’t bluff to please the one thought …

It may also be for this reason that the world is now increasingly oriented towards docu-films, non-fiction, documentaries … and some propaganda to circumvent the “voters” is an insult to intelligence, to History.

So let’s do it quickly and well,  fast conclude the bureaucratic process to ensure that it’s lean and agile and I mean no later than the end of September. At Christmas time IL FIGHTER D’ITALIA GIANCARLO GARBELLI is perfect!

Here the thrust of the sentence of the Right Justice of the TAR LAZIO Court,  that it could go further, but it did not, because the solution at hand if you want, is there.

Unless the Ministry of Culture intends to further challenge the Ministry of Justice for the third time on the same appeal, at that point I am sure as it’s in the logic of things that, it will “break the bank”.

Who knows if any national newspaper will have the “courage” to give a hand and highlight my rebellion against a system that is known to be decadent …in fact all the press are looking at me when is about boxing culture…

Sorry to my English-speaking readers, but I can’t translate all the document, here,  because it has technical expressions of the law, which I wouldn’t know how to translate or wouldn’t give the right interpretation. It’s a legislative document I cannot go wrong in its translation. And I’m not a strictly legal translator.  But for sure is 100% in my favor!
